When my bro showed me this site "Defending the Truth" and I saw the subject "The Courts [sic] System" I was AMAZED that there was not one mention of the family court system...not one! Rather that try to suggest or impose one particular view, I thought it more prudent and even-handed to introduce the subject with an open-ended question.

Apparently, my idea wasn't as great as I thought it to be, if for no other reason that it didn't foster an insightful, and productive response. My bad.

I think that the family court system has a tremendous, direct and personal impact on many, if not most, Americans. I think that the family court system produces the outcome of separating children from their fathers far more often than necessary. I also think that the family court now creates an incentive for married women to divorce (2/3's to 3/4's of divorces are initiated by women).

Over time, I think this will shift from a man/woman division to a vindictive/non-vindictive division. However, the principles that children should not unnecessarily be separated for a parent and the family court should not provide incentives for divorce will remain valid.

Without trying to sound too stuffy, outside of today's pandoras box topics of "the pledge of allegiance", "gay marriage", and maybe "the war", this is one of the areas that will have the the greatest impact on our future as a nation. My personal opinion is that there is a need for broad reform to insure that family court judges apply the law, and protect children's right to have both parents. That's my spiel.
My own experience from my divorce has led me to believe that there is indeed a place for the Family Courts and also a need.
Years ago, It was generally accepted that only the mother of a child in a divorce situation could be acceptable as a single parent. The courts seem to be expanding their viewpoints on this topic. More importantly; they are enforcing visitation rights more stringently nowadays. In many states denial of visitation is now a felony crime (Class C in my state).I have had to take my ex back to court for this very thing. The Family Court Comissioner that heard the case informed her after imposing a stiff penalty; " The next infraction will result in jail time. Do not make the mistake of thinking that women cannot be put in jail for this- they can, and will.
My ex had decided that she wanted more money from me and made the mistake of witholding my son from me. The Commiisioner told her that if she had a problem in that are, she needed to have a "Support Review"; but she exacerbated one situation by creating another one.
