Sounds fair to me.

And, perhaps the court proceedings aught to be looked into.

Keep in mind also, however, that the "intent" of an assaut plays a primary role in determining what a defendant while be charged with.

Perhaps a shoe isn't necessarily a weapon, per say.

But, if repeated blows to a person's head is made with use of a shoe with the "intent" to cause serious harm to that person, then a shoe can just as well be considered as a weapon even if this act didn't cause serious harm to that person.
