The constitution does not speak on this subject directly, considering the example that you just used. State law varies a bit here. With most laws, if there is a difference in age between, I think, two and four years (depending on the local law) the elder child can be charged. If the two are of the same age, then neither can be charged.

If the 'age of consent' laws change, the situation would chage as well.

You had asked about the PARENTS rights being violated. That is hat I was responding to.
