If you say so, but SD put an absolute ban up to vote once and it failed by a slim margin. If it gets approved by the voters, it'll be up to SCOTUS to again rule under yet another argument. It was changed once, it can be changed back. Since "legal" is a relative concept if you aren't gonna rely on what if "right" as support.
