HIS job was to see that the guy was insured.

There is NO QUESTION about his being insured - the insurance company stated he had been insured the requisite length of time

this commissioner might have had a leg to stand on if he were to arbitrate whether the guy had been eligible for the partner benefit of insurance - but he wasn't. His SOLE responsibility was to see that the guy was previously insured.
