There is already one state that allows gay marriage, and four others that grants civil unions or domestic partnerships.
The way this will make its way to the federal level is that these states laws stipulate that civil unions and domestic partnerships MUST be given all the rights and responsibilities of marriage. However, there are many instances of it not being that way in reality. So, it's going to end up being a federal Supreme Court case because the civil union is a separate and unequal version of marriage.
But, it will have to make its way through a few more states before that happens. | Also, people that get married in one state are going to eventually move to another, and when that state won't recognize their marriage, it will be a federal case. |
