If the people of Missouri wished to forbid the death penalty for minors, they have the power to do so, however, in this case they did not. Once again we see what happens when the judiciary oversteps it boundaries. Remember it was judicial activism that declared a slave property in Dred Scott and it was judicial activism that established the principle of separate but equal in Plessy v Ferguson.
