Well, it's a big law... Some of the Bush Administration's provisions regarding exemption from the Geneva Conventions and the withholding of due process were overturned in Hamdan v. Rumsfeld. The USA PATRIOT Act has a lot of things wrong with it, and it will take the Supreme Court a while to get around to all of them. The Supreme Court has a limited amount of time for a whole lot of cases. They really can't do everything instantly.
