I regard that as offensive speech.
And while I would want no part of such a stunt as Frederick's, the fact is, inoffensive, and popular speech probably don't need legal protection.
It is precisely unpopular, and offensive speech which need 1st Amendment protection. I suppose Frederick should get to keep his banner. But perhaps if there is divine justice in this case, he'll also get a spanking.
