Not really. Usually the courts do a pretty good job at deciding which parent is more qualified to hold custody.

Occasionally, they screw up. When they do, if you've got money, you have legal recourse. If you don't, unless you can interest groups such as the ACLU, you're pretty well screwed.

It is actually more complicated than that.

There have been issues where the state has taken a child from it's parents because they did not want their child to have a particular surgery or treatment that would save the child's life.

A prolonged court battle between parents on such an issue would probably result in the child dying before treatment in many situations.

Exactly! But she has to get custody first.

Although, in a life or death case, most Family Court Judges would issue a stay until the custody issue was solved.

I did make it simple, but I know from family experience that it can happen quick with a lawyer. I also know from family experience that this is also a harassment tactic by the non-custodial parent.

I didn't mean the question of custody in general.

I meant one parent deciding to
"continue treatment or allow the child to die, THAT decision rests solely with the custodial parent."

It doesn't 'upset' me, but it does give me pause. While I totally understand that someone has to have the 'final word', I can't say I celebrate at the idea of the non-custodial parent being legally 'taken out of the loop'. BUT, I can understand situations where the N-C parent is just being a pain to cause pain to the custodial parent. That shouldn't be allowed.

To my mind, if the N-C parent objects to treatment being discontinued, then they should have to take custody of the child. He/She shouldn't be allowed to demand that the other parent deal with the suffering of an extended death and then walk away from it.

I got an email yesterday about something along these lines.

A 17 year old boy had cancer, and his mother chose to go with holistic healing, with the boy's consent, and ended up curing his cancer. The boy is cancer free. Yet the doctor's went to court to have the mother removed as guardian and have now forced the boy to undergo chemotherapy, which he doesn't want, for a disease he no longer has.
