the next hypothetical

i thank everyone involved in the previous hypothetical thread. but there was another woman also raped at that new years eve party. lets look at her story.

she arrived with some friends and a few bottles of wine. she is single and likes it that way and while she has been sexually active in the past, she has not had sex for many months. they danced, partied, drank, but perhaps not in that order. some time after midnight, she was outside having a cigarette with a few of the other guests who also smoke. one of the guys slipped GHB into her drink.

a bit later, she was starting to get vague, groggy and stumble. the guy had been watching her waiting for this. he pretended to help her outside for another fag but they didnt stop outside the door. he lead her out to the back of the garden managing to evade any witnesses. by this time he was almost draging her as she was close to unconcious. in the bushes by the back fence he rapes her while she passes out.

the next morning she wakes, feeling dreadful. she recalls moments of the evening and puts it together over the next couple of days. she reports the incident to the police as soon as she is able to. a drug screen confirms GHB but fortunately is negative for pregnancy. she reports the person she suspects. the police track him down and find he died in a car accident driving home from the party.

she is quite overweight and has always had a very erratic menstrual cycle due to her having polycystic ovary syndrome. she is not surprised at not having a period for the next few months and her weight always fluctuates a lot. she has a bit of show of blood sometime in march but thinks nothing of it. in august she calls into work sick with gastro that she has not been able to shake for a few weeks now. the pains in her stomach seem to get worse and worse and she eventually asks her sister to drive her to hospital.

four hours later she has delivered a baby, premature but healthy. she is questioned at length to find out how she could possibly get pregnant and not realise, but she recounts the rape and she has not had sex with anyone since (or for months beforehand), her medical records confirm fluctuating weight for many years, erratic menstrual cycle for many years and recent abdominal pains that even her doctor attributed to gastro. they discover the original test done in january was mixed up in the lab with another woman with a similar name. cases of pregnancies being recognised only at delivery are rare for sure, but the do happen at times. this is one of those times. she genuinely did not know she was pregnant due to the rape. she genuinely is not pregnant to someone else. this IS a case of rape induced pregnancy.

she thinks about her options and eventually decides she does not want the baby. she calls in the doctor the day after delivery and discusses it with him. he agrees to help her and kills the baby with a lethal dose of propofol and potassium. it is done confidentially and without further consequences.

does anyone have a problem with this?

Absolutely i have a problem with that. All that is left for her as options are keeping the baby or giving it up for adoption. That's it.

First off, if the original hypothetical had been this detailed, it might have been a much shorter thread.
Secondly, that's a pretty horrific hypothetical. There's nothing right about any of that. The rape, medical negligence in mishandling the pregnancy test, and murder. Wow.

I can't wait to hear the "gotcha".

to answer a few points, this is purely hypothetical. if this is happening somewhere it is coincidental. i have been involved in a similar pregnancy to this one years ago, but this scenario is not a real event. it is concievable that it could happen.

and i agree it is an appalling situation from beginning to end.

and perhaps had the first hypothetical been so detailed it would have been shorter. this time i deliberately included the details that i was asked for the first time.

the interesting thing about these two scenarios, and the reason for juxtaposing them like this was simple. think the two situations through. what is the difference?

both are cases of a woman raped.

both reported the rape as soon as they were able to and both were investigated by authorities as much as possible.

both became pregnant as a result of the rape.

both women are healthy, mentally competent and both pregnancies are free of any complications, both "babies" are free of any congenital abnormalities.

neither wanted to be pregnant or raise a child.

both wanted to get rid of the "baby" as soon as possible.

both arranged for the "baby" to be disposed of by their doctor, confidentially and without further consequences.

so when the scenarios are compared, they are essentially the same.

the only significant difference is the age of the "baby". one is several months before delivery, one is a few hours after delivery.

those who have consistently argued that a foetus is not human have no problem. the first hypothetical is a request for abortion, the second is murder. these positions and the answer to each hypothetical question is completely consistent. that is why those who are pro choice were able to respond to these scenarios easily.

but it isnt so clear if you are pro consent. there is an argument that a foetus is a living human being, perfectly evolved and developed to live in its current environment, that it is a person and should command the rights any other person has. but it is a person created traumatically and without mothers consent. that makes killing it unfortunate but acceptable. that makes the mothers request for a safe, confidential abortion acceptable.

think this through. if lack of consent is a sufficient reason to kill a "healthy innocent baby" before delivery, why is it suddenly not a good enough reason to kill the same baby after delivery?

perhaps there is a difference between a foetus and a baby. in fact, there is a vast difference. a fundamental difference. a difference so big that the death of one is ok and the death of the other is murder. its almost like killing a 6 week old foetus isnt killing a person after all.....
