... it should be obvious that the CHANGE over time cannot be due to anything innate to boys. (And for the record Jefferson, I don't think that's what you're arguing. My comment isn't regarding the point you are making.)

Since the innate attributes of boys and girls can be said to be constant over this time, it should be obvious that the change is either due to a cultural shift in boys, or a cultural shift in how teachers treat boys. (The kid bringing the law-suit would probably agree with the latter.)

But the problem with the latter is that I don't really see any evidence of a cultural shift in the teaching. At least none that I could chalk up to be the primary cause of this decline in boys grade.

On the flip side, there has been a HUGE cultural change for kids and boys. Nintendos, X-Box, blah, blah, blah...

I think that the decline in boys grades is more attributable to a shift in the culture of the male students. And quite frankly, this kid is an example of that.
I couldn't imagine bringing such a stupid claim up 15 years ago. It would have been just unfathomable...
