Direct Taxes

The 16th Amendment to the Constitution, unfortunately, permits the collection of an income tax. I believe that it should be repealed and the government be financed by a "Fair Tax". If you are not familiar with it, then follow this:

I believe it was the 16th amendment that granted that power to the government. What a pity so much of our tax dollars go to waste on stupid hand-out programs and ill thought wars.

There were income taxes before the 16th Amendment. According to the United States Supreme Court, the 16th Amendment granted no new taxing powers to government.

The Constitution did not give the Congress the power to lay a direct tax. However, the 16th Amendment granted the Goverment the power to collect an income tax without regards to apportionment. Thus we have our now infamous progressive tax system.

The Supreme Court was correct in ruling that the 16th Amendment did not grant the government any new taxing powers, Congress always had the right to lay and collect taxes. The 16th Amendment removed the requirement for apportionment. Apportionment would require the individuals of a state to pay a percentage equal to their percentage of population of the Country. For example, if Alaska has 5% of the country's population, the residents of Alaska would be responsible for paying 5% of the country's taxes.

And the Supreme Court declared, in a unanimous opinion, that because the "income tax" was "without regards to apportionment", it was an excise tax, in the category of the indirect tax.

Direct taxes are not laid upon the individual. They are laid upon the States.
