No, he is not...although it is true that in CRIMINAL investigations a warrant is required for technical surveilance...that is not the case in National Security matters, the Presidents Constitutional powers (and indeed) his constitutional responsibilies supercede the lesser law.

Which constitutional powers would those be? As far as I know, the President does not have the power to supercede the law in the name of national security.
