being scalded is NOT the same thing as requiring multiple skin grafts. period.

you are using celcius measurements - in the U.S., the farenheit system has 212 degrees boiling point

I agree with the jury and the award 100%. Thank God that cup of coffee merely caused 3rd degree burns on this woman's lap (requiring several surgeries and skin grafts) and not on a baby's face.
After having been a waiter when I was younger just about all the old people who ordered coffee ALWAYS complained it WASNT hot enough. Once when this regular complaining couple came in I put the cup of coffee in a steamer for 2 minutes and the old geezer still complained it wasnt hot enough!

When I make coffee at home, I make it at marginally below boiling. I've been scalded when I've spilled nearly boiling water on me.

No, I didn't need multiple skin grafts. Did the woman who had coffee in McDonald's need skin grafts? That's pretty serious, and I'm surprised that happened from spilling coffee.

Ah, OK, I'd forgotten about the US temperature scale being different. I have no idea what fifty US degrees are, I'm afraid! I'm used to 0=freezing, 100=boiling.

Why 212 degrees for boiling, incidentally? Anyone know? It seems a very strange "unround" number!

fluff - I understand that needing skin grafts is very serious.

so did the jury- that's why they awarded this woman so much money

she had MULTIPLE surgeries for skin grafts across her abdomen and thighs.

You may have been scalded by below boiling hot water - that is NOT the same as being handed a (paper) cup of boiling coffee. Next time you boil water for something, stick your hand in it for a sec- see if it's the same as getting scalded.

Well, in that case I agree it's pretty serious.

I still think one should take personal responsibility for not pouring boiling liquids over oneself - if a waiter had done it, or the cup had broken, I could understand McDonald's culpability.

I mean, you've just told me "Next time you boil water for something, stick your hand in it for a sec- see if it's the same as getting scalded". If I take your advice, and get badly burned, would it be fair for me to sue you? Or would it be down to my own stupidity?

I'd go for the latter case, personally!

Thank you Tristin! I was beginning to think that I was the only person in America who knew the truth about the 'famous McDonalds coffee'. Hell, it was hot enough to melt the womans pantyhose into her skin.

Though I am NOT in favor of frivolous lawsuits - nor figuring out a way to make your neighbor pay off your mortgage - the woman at McDonald's had 3rd degree burns (burns that are often life threatening) and had every right to sue. I applaud her legal victory.
I'm sorry, I still don't believe she had 3rd degree burns from coffee.

I spilled boiling, BOILING, water, fresh from a kettle on my leg and only got 2nd degree burns.

fluff - it was handed to her through a drive-thru window and it spilled in her lap

know-e - whether or not you believe it, LOL, there was quite a lot of medical evidence provided at the trial before the jury awarded her the suit

The Actual Facts about the Mcdonalds' Coffee Case

You can get the basics from this article Knot.

BTW.....my previous statement regarding panty hose, should have read 'sweat pants'. Sorry about that. There's too much blood in my caffeine system at the moment.

The coffee wasn't boiling.

McDonalds at that time brewed their coffee at 180 degrees F. That is 32 degrees below boiling. Hot, yes, boiling, no.

I spilled water on my leg that was at 212 degrees and didn't get 3rd degree burns.

Most hot water heaters are set at about 120 degrees F, to give you perspective.
