Yep. I grew up watching them since we moved here in 1956. Saw them play in the minors before they went to the majors in 1969. My other favorite team is the Red Sox.

Oh, I've been a Mets fan since I was a kid.

And I, too, also like the Red Sox...specifically when they beat, cripple, and/or destroy the Yankees.

(I'm not a Yankee fan...as you can probably tell.)

I beg to differ with you here tristan. The lady bears most if not all of the responsibility here. One would expect that, when one purchases a cup of hot coffee, that is what they get. In this case, the woman purchased the coffee from her car at a drive thru window and, after pulling away from the window decides to put sugar in the coffee WHILE continuing to drive. Now, if she pulled over into a parking space to put the sugar in, I might feel differently but to put a cup of HOT coffee between one's legs to put sugar in while continuing to drive is just asking for trouble.

I couldn't agree more with you there...Accidents happen. And she had an accident because she wasn't taking enough precaution herself, to begin with.

well, jasgallo, LOL, the court, the juries, and the judge disagreed with you

and - the award WAS reduced on appeal (she only got 1/2 million) based on her part of the responsibility

it cannot be stressed enough that this case would NEVER have taken place if the corporation had just paid the medical bills for the third degree burns and skin grafts due to their negligence.

Exactly my point, Tristan. I would have to agree with the insurance company. The gate and lawn, I can see; but it's how the amount was arrived at for the tree which angered me. That, plus the fact that the other party decided to make a legal issue of it.

I agree with that, CF; but how does one arrive at the value of that tree? The original claim called for the "appeal value". To replace a full grown oak tree would cost more like a large fortune.

What might have made the difference is that Liebeck was wearing sweatpants which held the coffee next to her skin and gave it more time to poach her. That may explain why your injury was less serious, even though the water was hotter than the coffee--less contact time.
