Oh, for fuck's sake...

If you're going to reference Oliver Wendell Holmes, at least do it in a context that makes sense. He was talking about obscenity and incitement in relation to the First Amendment.

The law isn't about results, it's about what it says, and what it says is BAD.

You're the one who keeps telling us how people are losing their rights and the constitution is being abused and so on. Yet, you do not give us examples. What else am I to believe but that you are "crying fire in a crowded theater".

Justice Holmes was referring to legal limitations on freedom of speech when he used that phrase in Schenk v. United States, and he was referring to incitement. For example, if I said that I was going to kill you, it would fall under that catagory. Otherwise, you have no idea what you are talking about. I recommend that you sign up for a con law class at your nearest college. You might actually learn something.

The law isn't about specific cases, it's about what it says, and what the law says is a clear violation of the amendments to the Constitution which I enumerated.

Oh yes, you're so smart. What do you call what you are doing unless it's incitement? You have no examples. All you have is a bunch of scare tactics that you are repeating. You're hollering fire in a crowded theater. If you don't like that term and think it's stupid, I really don't give a flip. Maybe you should get out of your classroom and get some life experience so you know what the hell you're learning in those books Mr. Smarty pants (said with affection).

Here, does this help any?

Quote:
in·cite Audio pronunciation of "incitement" ( P ) Pronunciation Key (n-st)
tr.v. in·cit·ed, in·cit·ing, in·cites

To provoke and urge on: troublemakers who incite riots; inciting workers to strike. See Synonyms at provoke.

[Middle English encyten, from Old French enciter, from Latin incitre, to urge forward : in-, intensive pref.; see in-2 + citre, to stimulate, frequentative of cire, to put in motion; see kei-2 in Indo-European Roots.]
Feel free to refute the fact that what a law says is important at any time, or that this particular law is vastly unconstitutional. I'm waiting.

If it's vastly unconstitutional, when is it going to get overturned?

Well, it's a big law... Some of the Bush Administration's provisions regarding exemption from the Geneva Conventions and the withholding of due process were overturned in Hamdan v. Rumsfeld. The USA PATRIOT Act has a lot of things wrong with it, and it will take the Supreme Court a while to get around to all of them. The Supreme Court has a limited amount of time for a whole lot of cases. They really can't do everything instantly.

That's good. I hope they get so bogged down that that they never get around to it.

Yeah, I know what you mean. Who needs freedom anyway? It's downright unamerican if the government isn't staring over your shoulder and into your business.

The government is not bothering me. How are they bothering you? Are you trying to kill Americans?
