Sure, but the executive has power under "checks and balances" itself.

And even if Bush invented a category of fighter (he did not), what authority does the court have in "calling his bullshit?" What are the checks which the courts have? So far, I have seen none presented. It seems that their authority is absolute.

As I mentioned before the court has the power of "judicial review" as established by Marbury v. Madison. The senate can impeach judges and remove them from office, so there's a check. The president nominates judges, so that's his check. The presidential powers presented in the Constitution are somewhat limited, since our founders tended to favor the Congress. This is all basic civics and American history. None of the branches have absolute authority.

Here's a nifty little diagram for you.


"Enemy combatant" is a new classification invented by the Bush administration specifically for the purpose of circumventing the Geneva Conventions. In Hamdan v. Rumsfeld, the courts ruled that the president has to give the basic rights of the accused to prisoners at Guatanamo Bay, and the protections afforded by the Geneva Conventions whether he considers them "Prisoners of War" or not.

Your argument is indeed that judicial power is absolute-providing that the executive and legislative do not object.

The powers which the executive and legislative have are their powers. Those powers cannot be limited by the judiciary. That is not a violation of "checks and balances" or "separation of powers," but rather its fruition.
