There are some circumstances that I think that capital punishment is warranted, and justified.
Examples are serial child molestors and serial killers. People like Wesley Allen Dodd and John Wayne Gacy are the epitome of evil, and do not deserve to live, IMO. The possibility of them ever getting out, one way or another (well, not now, because they are dead, but you know what I mean....) is just too scary to think about.
A good example of what I'm talking about is Kenneth McDuff. CNN - Man blamed for 14 murders executed in Texas - November 17, 1998 | Yeah, Gacy was executed in 1994 by lethal injection.
Charles Manson was sparred by the death penalty because congress and/or the senate abolished it in the 1970's. And now there may be more bodies lying near the ranch where he was captured for the last time.

People commit crimes because of the way society is run, rather than in spite of the way society is run. By that I mean society, whether US or European or anywhere else, is rotten to the core. Those in power want to stay in power and imprisonment and/or capital punishment for those who break their rules is one of the means by which the powerful maintain their position.
Under those circumstances, how can one possibly support capital punishment?

(a) Offense.— Whoever, whether inside or outside the United States, commits a war crime, in any of the circumstances described in subsection (b), shall be fined under this title or imprisoned for life or any term of years, or both, and if death results to the victim, shall also be subject to the penalty of death.
(b) Circumstances.— The circumstances referred to in subsection (a) are that the person committing such war crime or the victim of such war crime is a member of the Armed Forces of the United States or a national of the United States (as defined in section 101 of the Immigration and Nationality Act).
(c) Definition.— As used in this section the term “war crime” means any conduct—
(1) defined as a grave breach in any of the international conventions signed at Geneva 12 August 1949, or any protocol to such convention to which the United States is a party;
(2) prohibited by Article 23, 25, 27, or 28 of the Annex to the Hague Convention IV, Respecting the Laws and Customs of War on Land, signed 18 October 1907;
(3) which constitutes a violation of common Article 3 of the international conventions signed at Geneva, 12 August 1949, or any protocol to such convention to which the United States is a party and which deals with non-international armed conflict; or

Here's my position on the death penalty: It's too damned easy and it costs too damned much!
All violators of law should be placed in different categories and punished for violating the other lawful citizens expected norm. This should be done fairly and consistently with no cost to law abiding citizens.
Felons, now in death penalty/life sentences should lose all rights as citizens and be placed in a commune that is self supporting. A place like the Alaska National Wildlife Reserve isolated from law abiding citizens. The commune would be fenced, triple fenced with land mines and protective air space equal to that of Washington DC. Inside of the commune would be barns, animals, tools, seeds and a source of clean water similar to a Quaker lifestyle in PA minus houses. Inmates would be self sustained by their labor and produce all items consumed.
Once placed in the commune they would be free within the commune and be self reliant requiring cooperation between inmates or death from internal law established by inmates. Those requiring medical/dental care would exit the facility through the only entrance/exit tunnel nude to be treated and returned. |
