Ummmm... no.. that would be an aggravating factor. It shows that the defendant could represent a random threat to anybody who is, or who he percives to be (fill in the blank.)

It's common freakin' sense that you don't want people like that running around on the streets.

It's common freakin' sense that you don't want people like that running around on the streets.
and it's common freakin' sense that hate crime sentencing will keep them incarcerated longer.

as I said before, we're never going to agree on this LOL

I will agree that everybody has his or her veiw on this very subject, and are unwilling to change it. I freely admit that I will not change mine. The whole form of our arguments could be made for many of the thread topics on this forum. Gun Regulation, for example. Religion, for another example.

Hate Crime,Freedom of Hate Speech Covers Alot.
Many individuals seem to always love to use words that projects
bitter, and can cause great harm to others who may not agree
with what is being said. From my understanding a hate crime can
be any of the various crimes, such as (assault or defacement of
property) when motivated by hostility to a victim as a group, and
can be based on color, creed, gender,or sexual orientation.

This can include freedom of speech whenever one may feel strongly
about a matter, and along comes someone who dis-encourage or
flatout dis-agree with what the person is saying.

I attended a conference yesterday (Saturday) concerning the
topic Affirmative Action. Opps!!!! My mistake I forgotten that
this is about Freedom of Speech, but some of the questions
that was talked about created a negative environment, and I
felt that the freedom to ask and get answers was violated.
(Later Read details under Affirmative Action).

As far as I am concerned whenever there's a dis-agreement
over a statement that I have posted (that's me expressing
my own concern), and for some of you to say that I am being
a racist or attacking is a violation.

Whenever I register on a new forum I do read the terms of
service, and I agree to them by checking yes I accept.
No where in the agreement does it say I can't react when
being attacked, but it does say about respecting other posters,
and this is why I say Freedom of Hate Speech is a violation
that covers alot.

That's probably because these hate crime laws seem to be enforced on an Affirmative Action basis.

Every person in America driving down a freeway can be perceived as a random threat.
You can't control what others say, you can only control how you react to it.-Unknown
