Are you an outside observer Cyn?

It's irrelevant.

You can play what-if games till the cows come home, but it doesn't reduce the horror of the crime.

And I don't agree that the rape of other women should somehow be diminished because they are not "transgendered".

Gary, I will agree with you on this point. We are not concentrating on the actual crime, people. This was rape.Whenever crime is even discussed, this must be the first, and focal point of our thought process, IMO. Let the defense attorneys and prosecutors concentrate their efforts to innocence or guilt; and if guilt should be the verdict, provide the jury with any and all mitigating or aggravating circumstances.
But to further fan the flames of discussion: Why is a crime of passion seen as a mitigating circumstance? Should this be even allowed in our court system?

It's not hard for me to understand, Knot.. I get it.

That was their supposed "excuse" for raping her.

To which my respone is, so what? Rape is wrong. There's never an excuse for it.
Say hello to prison.

Exactly my point, Carpenter. Who cares about excuses? A crime was commited. Period. That crime must now be punished. But, I will say: these perpetrators are going to have rape defined for them in such a way that no law or DTT discussion ever could, in a little while.
