Well the problem with all this is that the topic is being trumped by personality conflicts here.

Now the way I see it, though I have on many issues found alignment with Tristan, I do not see this example as one that shows the hate crime law is working. And Tristan, I do believe there is a valid place for a hate crime law, but this case does not clearly demonstrate to me, at least, how it worked here. In fact, I find it exposes areas that are amiss with the hate crime law, as it was even applied to this case.

So shouldn't we get back to the topic at hand?

I agree with you as regards this case. I read elsewhere that the jurors were not convinced that it was a hate crime. But because of the way the charges were brought -- or perhaps the way the way the law in their state is written -- they were forced to either convict the defendant of manslaughter as a hate crime or acquit him.

I know that in some states any hate crime charge is a separate charge. The jury is then free to find the defendant guilty of the one charge -- in this case manslaughter -- without being bound to also convict on the hate crime charge.

This seems to me to be a more reasonable way of constructing the statutes because the jury would not be so bound by the whims of those in the prosecutor's office.
