In October, 2006,... Justice Anthony Kline wrote, "[T]he inescapable effect of the analysis the majority adopts is to diminish the humanity of the lesbian and gay men whose rights are defeated. The right to marry is of fundamental important for all individuals."
As the People of California have already made their opposition to the redefinition of marriage for homosexuals abundantly clear, judges will need to cite something more than their touchy-feely emotions about "diminishing humanity".

Let us hope and pray that the CA Supreme Court sees sense and follows the brilliant conclusions of its New York equivalent from July 2006:


"We conclude, however, that there are at least two grounds that rationally support the limitation on marriage that the Legislature has enacted.

First, the Legislature could rationally decide that, for the welfare of children, it is more important to promote stability, and to avoid instability, in opposite-sex than in same-sex relationships.

Heterosexual intercourse has a natural tendency to lead to the birth of children; homosexual intercourse does not. Despite the advances of science, it remains true that the vast majority of children are born as a result of a sexual relationship between a man and a woman, and the Legislature could find that this will continue to be true.

The Legislature could also find that such relationships are all too often casual or temporary. It could find that an important function of marriage is to create more stability and permanence in the relationships that cause children to be born. It thus could choose to offer an inducement -- in the form of marriage and its attendant benefits -- to opposite-sex couples who make a solemn, long-term commitment to each other.

There is a second reason: The Legislature could rationally believe that it is better, other things being equal, for children to grow up with both a mother and a father. Intuition and experience suggest that a child benefits from having before his or her eyes, every day, living models of what both a man and a woman are like

Apparently the homosexuals were using the same failed, worn out arguments yesterday.

Let's pray that the court kicks out this savage attack on traditional marriage in the same way it nullified those ludicrous pantomine antics in San Francisco 4 years ago.

Let's not. I'm hoping the court rules in favor of marriage equality and becomes the second state to give gay couples "equal protection under the law." It's long overdue.

I notice you're from the UK where gay couples have marriage rights. Your country hasn't collapsed into moral ruin. I have yet to hear of people in the UK rushing to the alter to marry their hamster, their grandmother, or a toaster oven. Nothing much has changed at all.

Britain doesn't have homosexual marriage, it has a form of civil partnership which precludes marriage. It's merely a re-packaging of previously available rights.

Not true. Only straight couples' relationships are protected through the rights and bennies given with the marriage contract. Gay couples have a right to those protections, too.

Gay marriage would pass with flying colors in Massachusetts. Fortunately we don't need to waste taxpayer dollars with such foolishness.
