Can't happen.

If they're legally sanctioned, they cannot be rendered invalid. They might change the laws and make future gay marriages impossible. But there will always be gay marriages in CA after they begin to accept them.

Both sides have arguments. Gay marriage advocates will probably have the most difficulty with the argument that even if the marriages cannot be voided retroactively to the date of the Calif. Supreme Court decision, that the marriages will have no legal effect after the date of the amendment.

From the other side, how can they argue that all the marriages should be nullifed retroactively? Assume Joe and Jack get married today. They do not have a will. Jack dies and Joe, as the surviving spouse, obtains the benefits that a surviving spouse gets under Calif. intestate succession.

What's the state going to do if the constitutional amendment passes -- come take all of the inheritance that Joe has already received?

Ongoing benefits will be the tricky issue, since a pronouncement of retroactivity could result in their termination.

Homosexuals from outside CA who come here to get 'married' will also lose their case for recognition back home if our ballot is successful.

Joe and Jack can visit an attorney and draw up a will. Most married couples do that anyway.

We don't need to redefine marriage to provide insurance deductions for homosexuals

I never said differently.

I never said that the marriages performed in 2003 were legal - they were quite clearly NOT...even though I approved of them personally.

That was a very very very different situation than marriages that are performed legally.

Irrelevant.

When the drinking age was raised to 21, people aged 18 to 20 didn't retain the right to drink they previously had.

No 'grandfathering" applies to these sham marriages either, especially the ones from out of state.

but, if it does happen, I think you'll find out that you're wrong ... and the final ruling will be made by the people who believe that gays should have equal marriage rights anyway

The best analogy yet on this stupid comment of gaysher...

Equal marriage already? You mean gays have the right to pretend to be straight if they want to marry.

That would be like the government banning ALL religious practices except Buddism - but it would be EQUAL RELIGIOUS RIGHTS FOR ALL because ALL would have the EQUAL right to worship Buddha.
