And wills can be and frequently are challenged by legal relatives if the beneficiary is not a legal relative. There is no such thing as a legal document that can be drawn up by an attorney to designate a non-relative as your legal next of kin.

True, an attorney cannot make a non-relative a relative (except through the adoption process, which requires court approval and which is not relevant to the issue on this board).

Greedy people will always contest wills. Some of these disputes will be reduced if gay marriage is approved.

Dissolving an estate is one of the roughest things I have ever dealt with. The banks want to keep the money.

I have never even heard of cousins or siblings of the decedent contesting the will when it left everything to a long time spouse. I have not only heard of them contesting when a will left everything to a longterm gay partner but I have heard of them winning.

If gay marriages are approved, I am fairly certain that greedy relatives contesting any such will in the case of couples that have been together for decades are going to lose.

Absolutely. I knew a gay railroad engineer who had accumulated six older Victorian houses and filled each with expensive antiques. His co-workers and friends didn't think he had any relatives because he never talked about any relatives and clearly were never visited by any of them.

When he died, he all of a sudden had about 30 relatives, all clamoring for the antiques. He had no partner or will when he died, so some of these relatives received the antiques and houses.

The lesson: have a will.

Marriage Is Hard Work
I'll have been married 25 years on June 10 (hopefully, and that's really not a joke). From a practical viewpoint, if two consenting adults want to try it, why not let them?

Note: I said two consenting adults because we really don't need the usual bestiality/pedophilia followups.

Spouses are first in line in the legal inheritance heirarchy. This is another reason why marriage equality is so important. Gay couples shouldn't have to pay some attorney for what straight couples get for free. My partner and I spent a LOT of money on our wills and personal affairs - not everyone can afford that.
