Wisconsin gay couples who marry outside state could face penalty
Madison - When Dick Myers heard that California was going to start issuing marriage licenses to same-sex couples, he and his partner of nearly 13 years considered traveling there to get married.

That is until Myers and his partner, Steve Brondino, learned of an obscure state law that makes it a crime for Wisconsin residents to enter into marriage in another state if the marriage would be prohibited here. The law imposes a penalty for those who enter into a marriage that's prohibited or declared void in Wisconsin of up to $10,000 and nine months in prison.
"If we would go to California and come back here, what are the chances we might be prosecuted?" Myers asked. "Neither of us could afford the legal costs in defending ourselves."

Prosecuted and jail time, just for getting married. Wow, that is just WRONG.

Sounds like a loophole was left from the era of when it was illegal for whites and non-whites to marry...

That's EXACTLY what it is. Now I'd like to see people say there is no link between the black and gay struggles for equality.

That law is way too extreme. It will be changed in time.

I was reading another article on this yesterday and it said that the law was passed to prevent underage couples from getting married in a state where the age requirement is lower than in Wisconsin.
Right now America spends $700 billion every year on foreign oil. That's our money going overseas when it could be staying here. We have to stop this.

Ok...But that kinda doesn't make sense.

Wouldn't that mean then that the parents of the minor(s) would then be the ones actually fined, not the underage couple? And considering most underage kids that go out-of-state to marry, are usually eloping...Meaning their parents weren't giving permission in the first place for a marriage allowed in the case of minors?

So how could they fine the parents for 'unlawful' marriages when minors aren't under any financial obligations/restitutions to begin with because they ARE minors?

And if that's the case then...Would seem that legal aged Wisconsin citizens getting married out-of-state would be exempt to begin with if that law is 'age related' not 'gender related'. Otherwise, I'm sure there's several hetrosexual married couples in Wisconsin that could also be fined under that law. Not just SSM couples.

And if they're not applying the law equally to ALL out-of-state marriages (of legal age citizens)...Then trying to apply it solely to SSMs will have it thrown out.

Before we draw bullshit conclusions, wouldn't it make more sense to learn the truth about the situation?

It's funny how some people make the asinine statement to get educated before you make a statement on homosexuality, but they don't take their own advice on other subjects.

Another article from Wisconsin..
I wonder why that didn't make it on this site?

Wisconsin Gay Couples Could Face Jail For Marrying In California
by 365Gay.com Newscenter Staff Posted: July 2, 2008 - 3:00 pm ET
(Madison, Wisconsin) Same-sex couples from Wisconsin who go to California to marry could find themselves facing criminal charges when they return home.
A little known Wisconsin law makes it a criminal offense to enter into a marriage outside the state if that marriage were illegal in Wisconsin.
While the law was passed decades ago to prevent underage couples from crossing state lines to marry it could be used against same-sex couples the Madison Capital Times reported Wednesday.
The penalty is a fine of up to $10,000, nine months in prison, or both.
Wisconsin law limits marriage to opposite-sex couples.
Same-sex marriage became legal in California following a state Supreme Court ruling that went into effect June 17. Unlike Massachusetts which limits gay marriage only to out-of-state couples whose marriages would be legal at home the California ruling opened up marriage to anyone.
LGBT civil rights group Fair Wisconsin is warning couples they could face arrest if they marry in California.
It is not known how many gay and lesbian couples from the state have wed in California. One couple from Madison who are preparing to marry say they are willing to take the chance.
"It would be interesting to be prosecuted," Bob Klebba who is planning to marry longtime partner David Waugh told the Capital Times. "It would really bring up a reaction in the public sentiment."
In 2006, Wisconsin voters approved a constitutional amendment limiting marriage to opposite-sex couples.
Fair Wisconsin said it is now focusing its efforts on seeking passage of bills granting recognition of domestic partnerships.
Spokesperson Glenn Carlson said he is hopeful of getting a bill passed in the next session of the legislature.
