Also, just to be completely accurate, "common defence" is mentioned in the Preamble to the Constitution...which has no legal bearing at all.
All the Preamble does is set out what the Founding Fathers were attempting to do by creating the Constitution. The LEGAL ramifications of the Constitution start with Article I |

Because they are subject to the Constitution and no state can legislate something that goes against it. It's been done, and it's been overturned. |
