I've no comment on that.

I've seen those with advanced degrees that were excellent communicators and I've seen those that couldn't describe things if they were showing people pictures.

Such is the nature of scientific minds.

I hate to say it, but the average layperson does not know government, economics, philosophy, law, etc. as well as the average political commentator.

I'd mention Brown V. Board of Ed. or the Civil War, but you'd just bitch about me going off topic and try to make it seem irrelevant.

Do you even bother reading the whole statement? I wasn't saying it's a "whim." I'm talking about the idea of taking all of your advice from common people. We are more educated and informed than our ancestors, but still have generally shallow views on the issues, easily corrupted by emotion, personal experience, etc. Public opinion is an excellent indicator of popularity (about 50% of the US population approves of gay marriage, and I'd imagine more are for civil unions) but it is not the deciding factor.

You'd love that, but no. I mean take common peoples' opinions into account when making decisions on issues such as this. It's a good indicator, but it can be right or wrong. Keep in mind that Truman got very low poll ratings after he fired General MacArthur during the Korean War, simply because he didn't want a war with China. For his lack of anti-communist jingoism he suffered, but he still did the right thing.

Why should they been seen different in the eyes of the law?

By your standard the law should look at inter-racial couples differently also...

By your standard the law should look at inter-racial couples differently also...
Do you mean a mixed-sex inter-racial couple or a same-sex inter-racial couple?

And why introduce race into the equation?

It was your suggestion ! Personally I prefer the idea of letting We The People decide

I mean take common peoples' opinions into account when making decisions on issues such as this. It's a good indicator, but it can be right or wrong.
So we let the people have their say, then after we've been through the formalities we let some special interest group make the final decision?

Have you really thought this through?

How does it matter if the sexes are mixed in the eyes of the law?

How do you not see the clear parallels between race and sexuality here?

My point is that the law has no obligation to treat different groupings in the same way, just because they happen to be a couple, just as the law does not treat groups of more than two in the same way. Legal rights accrue to individuals.

No, and I think it's misleading to draw the comparison.

Of course it was wrong to have laws preventing men and women of different races from marrying, but that was a peculiarity of the US's racist past. I don't know of any other countries that had laws mandating racial segregation apart from South Africa.
