How about other "rights" that have since been included in the Bill of Rights, did they also pre-exist and were just overlooked or forgotten? And if these alleged "rights" were granted by the Creator how come they are arbitrarily granted to Americans? And why do Americans lack rights granted to citizens of other countries, presumably by the Creator?
