Thanks to gun control laws, the .38 special was made illegal. So it is the government's fault that some people are unable to own guns. So therefore it must the the government's responsibility to protect them.

Todd Kim, the solicitor general for the District of Columbia, noted, in arguments to the Court of Appeals: "We interpret the Second Amendment in military terms", declaring that the city would also have the authority to ban all weapons. Judge Laurence Silberman, one of the Appeals Court Judges hearing the arguments, queried: "Show me anybody in the 19th century who interprets the Second Amendment the way you do. It doesn't appear until much later, the middle of the 20th century."

It says "created equal". It doesn't say anything about being treated equal.
