This means if he could reasonably forsee that his behavior would result in the death of another human being he is guilty of 1st degree murder..I don't think he would be charged under this but what he did was with malice

I do understand malice aforethought. Though I was not familiar with the Latin term mens rea.

Here is the short version:

Quote:
malice aforethought
n. 1) the conscious intent to cause death or great bodily harm to another person before a person commits the crime. Such malice is a required element to prove first degree murder. 2) a general evil and depraved state of mind in which the person is unconcerned for the lives of others. Thus, if a person uses a gun to hold up a bank and an innocent bystander is killed in a shoot-out with police, there is malice aforethought.

law.com Law Dictionary
You think he behaved recklessly and without concern for the lives of others.

I agree that he was reckless. But I also think that we have the advantage of hindsight.

Without that advantage, a responsible person might also have predicted that the burglars, armed only with a crowbar, would surrender when confronted with a shotgun. And if they had, Horn would have been hailed all around as a hero.

Right now America spends $700 billion every year on foreign oil. That's our money going overseas when it could be staying here. We have to stop this.

How is calling him by his name an attack ??

Question, you didn't answer the question, question, you didn't answer the question, which signifies a head banging motion at the wailing wall.

At Gary's core is no basis for right or wrong, only his interpretation of the "Rule of Law", because "GOD said".
Sounds like you can't refute my message so you're attacking the messenger

Gary is not my real name but you can call me Gar if you like, or Savvy. Either way I won't be offended.

If he had stayed in his house as requested by the police then no confrontation need have taken place. No hindsight was needed by him to realise this.

Your defence simply doesn't withstand close scrutiny.

And no Judge would believe your absurd tactic of always saying "I explained this already and I don't want to repeat it", when you have merely stated an assertion without any attempt at substantiation.

Ever heard the comedian Raymond J. Johnson, Jr.?
