When a company hires an individual they check their Social Security card, and if the name and numbers they provide match then they continue. From time to time the Social Security Agency will send out letters to employers and individuals when they find a descrepancy with the names and/or numbers provided.

So the Congressman is saying that if this company checks any of the information that they were notified about that was mismatched, and if the employee cannot confirm the information within 60 days, the company was going to fire them, but now not only can they not fire them, they could face legal repricussions if they did. So now a Congressman is telling a company to break the law. I wonder, if the company is found to be employing illegal immigrants will he also pay their fine. I doubt it, he will then demonize the company for hiring the illegals. What a crock.

Thanks, Sarge. It is a crock. This is a double-edged sword. Possibly Cintas has about 32,000 undocumented employees. How did happen? Was it because Cintas chose, like quite a few companies, to hire illegals to save money on taxes, salaries, and employee benefits? Now they are being told that they cannot fix this problem? Hopefully; this is because the authorities want to fully prosecute this company for its hiring practice, and not because of politics.

Cintas has 400 employees who they have been notified of the "no-match" by the Social Security Administration. The new regulations by Homeland Security have been enacted to help companies to catch those who are working illegally in this country and to allow those who have legitimate errors the opportunity to correct them. I myself have received a no-match letter for the SSA. I was born in Pittsburgh, PA however, my social security number reflects a birth in Washington D.C. The problem was that I applied for my SSN while my dad was stationed in DC. So when my number was issued it was issued with a DC origin. I took me about a month to clear up this problem.

What the Congressman is telling this company is to break the law. Instead of checking the validity of its employees and then taking action to correct the hiring of illegals, the Congressman is telling the company if we do we will prosecute you. Now, if Cintas follows the Congressman's threat, and then is found to have hired illegals, they will also be prosecuted. Damned if you do, damned if you don't.

If a company finds that it has illegals working for it, it should have the right to terminate their employment. Sometimes the only way a company can find this out is throught the no-match letters. Currently, Cintas is placing those with the no-match on administrative leave, allowing them time to resolve their problems. Here we see a business trying to do the right thing and what does it get them, threats from a Congressman. Such much for the law.

Something for me to take not of and keep an eye on, thanks indago.

The administrative leave is probably the safe course for right now; and I understand your frustration . It has developed into a damned if you do and damned if you don't situation. I hope I don't anger you with my question, Sarge; but don't you think Cintas could have avoided this in the first place by double-checking all appropriate documentation in the first place? There are free websites available that can check the validity and issuing state for all Social Security numbers. I had to use these resouces after the company I worked for got caught in a similair situation; altbeit without the political infighting. We got hit hith fines; but after that the company assidiously checked all documentation. I no longer work for this company because I'm now disabled; but I still keep in contact with my for co-workers and employees. My information to date is that the company still is keeping to this policy; but if they aren't; then they also need to be held accountable.
